Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you ("you", "your") and BuzzWire ("BuzzWire", "we", "us", "our"), a service operated by Ranjeet Kumar Vimal, an individual (sole proprietor) based in Bangalore, India and trading as "BuzzWire". They govern your access to and use of the BuzzWire website, application and services (together, the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. If you use the Service for a business, you represent that you are authorised to bind that business. You are responsible for keeping your login credentials secure and for all activity under your account.

2. What BuzzWire is

BuzzWire is a tool that lets you automate replies on Instagram through Meta's official Instagram Graph API — including comment-to-DM, keyword replies, story-reply automation and in-DM lead capture. BuzzWire is a Verified Meta Tech Provider, but it is an independent product and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram.

3. Your Instagram account and Meta's rules

To use the Service you connect an Instagram Business or Creator account through Meta's official login. You are solely responsible for complying with Meta's and Instagram's terms and policies — including the Meta Platform Terms, Instagram Terms of Use, Instagram Community Guidelines and the Instagram Platform Policy, as updated from time to time. You authorise BuzzWire to access your Instagram data and to send messages on your behalf, only to the extent of the permissions you grant, and you may revoke that access at any time by disconnecting your account.

4. Acceptable use

You agree that you will not, and will not allow anyone else to:

  • send spam, bulk unsolicited messages, or message people who have not first engaged with you;
  • send unlawful, deceptive, misleading, harassing, hateful, infringing or otherwise prohibited content, or promote illegal or restricted products;
  • violate any applicable law, including anti-spam and privacy laws such as GDPR, CAN-SPAM, TCPA, CASL and the Australian Spam Act;
  • collect, use or share other people's data without a lawful basis and any required consent;
  • attempt to circumvent rate limits, safety features, or Instagram's messaging policies;
  • reverse engineer, scrape, resell, sublicense or copy the Service, or use it to build a competing product;
  • connect an account you do not own or are not authorised to manage, or interfere with the Service's operation or security.

You are solely responsible for the messages, links, offers and content you send, and for having any consent or lawful basis required to contact your recipients. We may enforce safety guardrails, but you remain responsible for how you use the Service.

5. Account safety — no guarantee; assumption of risk

BuzzWire provides safety features (such as rate limits, warm-up ramps, per-user cooldowns, human-like delays, opt-out handling and automatic pausing on certain policy signals) that are designed to reduce risk. However, Instagram and Meta control their platforms and make all enforcement decisions in their sole discretion. You acknowledge and agree that:

  • using any automation on Instagram carries inherent risk, and we do not and cannot guarantee that your account will not be warned, rate-limited, restricted, shadow-banned, suspended, disabled or terminated;
  • Meta and Instagram may take action against your account at any time, for any reason or no reason, and regardless of whether you or BuzzWire complied with their rules or used BuzzWire's safety features correctly;
  • BuzzWire's Verified Meta Tech Provider status, safety features, documentation, guidance and marketing are not a promise, warranty or guarantee of any outcome or of account safety;
  • we are not responsible or liable for any action Meta or Instagram takes against your account, for any change they make to their APIs, features, availability, pricing or policies, or for any resulting loss of followers, content, access, reach, revenue, opportunities or data; and
  • you use the Service and all automation entirely at your own risk, and you assume full responsibility for that risk.

To the fullest extent permitted by law, we disclaim all liability arising out of or relating to any warning, restriction, suspension, disablement, ban or other action affecting any Instagram, Meta or other third-party account, however caused.

6. Plans, billing and payments

BuzzWire offers a free plan and a paid "Pro" plan (currently US$9.99/month or US$79/year, subject to change). Paid plans are sold and processed by our Merchant of Record, Dodo Payments, who acts as the seller/merchant of record for your purchase and handles billing, currency conversion, applicable taxes and invoicing. Your purchase is also subject to Dodo Payments' terms. By subscribing, you authorise recurring charges until you cancel. Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled. New sign-ups may receive a 14-day Pro trial; if you do not cancel before the trial ends, your selected plan begins and your payment method is charged. We may change pricing or plan features on a prospective basis.

7. Cancellation and refunds

You can cancel at any time from your account settings or by emailing support@buzzwire.io. Cancellation stops future renewals; your Pro access continues until the end of the current billing period. Refunds are governed by our Refund Policy.

8. Free plan and fair use

The free plan is provided "as is" and may include a "Powered by BuzzWire" label on outgoing messages. We may apply reasonable technical and fair-use limits, and we may modify, limit or discontinue the free plan at any time.

9. Intellectual property

BuzzWire and all related software, designs, trademarks and content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. You retain ownership of the content and data you provide ("Your Content"), and you grant us a licence to host, process and transmit Your Content solely to operate, secure and improve the Service.

10. Third-party services

The Service relies on third parties, including Meta/Instagram, Dodo Payments, and our hosting, infrastructure, email and analytics providers. We are not responsible for third-party services, their availability, or their acts or omissions, and your use of them may be subject to their own terms.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT IT WILL PRODUCE ANY PARTICULAR RESULT OR KEEP ANY ACCOUNT COMPLIANT OR SAFE. We do not warrant any results, revenue, deliverability, or that automation is permitted for your particular use.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUZZWIRE AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, FOLLOWERS OR DATA, OR FOR ANY SUSPENSION, RESTRICTION OR LOSS OF ANY INSTAGRAM OR META ACCOUNT, ARISING FROM OR RELATED TO THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICE (INCLUDING VIA OUR MERCHANT OF RECORD) IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50. Some jurisdictions do not allow certain limitations; in that case, the limitations apply to the fullest extent permitted, and nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You will indemnify, defend and hold harmless BuzzWire and its operator from and against any claims, damages, liabilities, losses and expenses (including reasonable legal fees) arising from or related to: your use of the Service; Your Content and the messages you send; or your violation of these Terms, the acceptable-use section, any law, or any third-party rights (including Meta's or Instagram's terms and your recipients' privacy rights).

14. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure, or misused the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification and governing law) will survive.

15. Changes

We may modify the Service or these Terms. If we make material changes, we will update the "Last updated" date and, where appropriate, provide notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to any mandatory consumer-protection rights you have in your country of residence, the competent courts located in Bangalore, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Before starting any formal proceeding, please contact support@buzzwire.io so we can try to resolve the matter informally.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them, for example in connection with a sale or transfer of the business. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service. We are not liable for any delay or failure caused by events beyond our reasonable control.
